Booking terms
Last updated: 13 October 2026 · French version (authoritative)
Article 1 – Purpose and scope
This English version is a courtesy translation: only the French version is legally binding.
These booking terms (general terms and conditions of sale) govern the tattoo services I provide to private clients, from the project request to the session. In these terms, ‘I’ means Sergio Duro Godoy, sole trader (entrepreneur individuel, EI), who works as Sergio Duro, and ‘you’ means the client, a consumer within the meaning of the French Consumer Code (Code de la consommation).
They apply to every booking made through this website: project request, personal proposal, choice of a slot, order and payment of the deposit, by bank transfer or by card. You accept them by ticking the box provided on your booking page before confirming your order. The terms that apply are those in force on the date of your booking: the date of their last update is shown at the top of this page, and the confirmation email contains a link to them. I keep proof of your acceptance for 5 years.
The contract is made with Sergio Duro Godoy EI. Sessions take place at the Cœur de Vaurien studio, 10 rue Poincaré, 68100 Mulhouse, France, where I work.

- Health declaration: tattooing activity declared on 2 June 2026 to the Grand Est regional health agency (Agence régionale de santé, ARS Grand Est), receipt dated 5 June 2026, under article R1311-2 of the French Public Health Code
Article 3 – Project request and proposal
Everything starts with the project request form. Sending a request is free and commits you to nothing. I study each one personally: there is no automatic acceptance and no price worked out by an algorithm. I may then ask you for more details, send you a proposal, or decline a project that does not fit my work or that I could not carry out to a proper standard.
My proposal comes by email, with a link to your personal booking page. It sets out the estimated duration, the number of sessions planned and the estimated price, worked out from the description and photos you sent me. The final price is set at the studio, according to the work actually done. If the project changes at your request, or if it becomes clear that the estimated price will be exceeded, I tell you before starting or continuing: the new price only applies with your agreement.
As a guide, tattoos start from €80. This is not a price list: the price of your project is the one in my personal proposal, under the conditions above.
The booking link is valid for 14 days. Through it, you choose one of the slots I have opened for the length of your session, up to 3 months ahead.
Before you place any order, the pre-contractual information required by articles L111-1 and L221-5 of the French Consumer Code is given to you on this website, in my proposal and on your booking page: identity of the service provider, main characteristics of the service, price, payment and performance arrangements, rescheduling and cancellation rules, right of withdrawal and mediation.
The contract is formed when, having accepted these terms and chosen how to pay, you confirm your order by clicking the ‘Confirm this slot – order with obligation to pay a 50 € deposit (arrhes) by bank transfer’ or ‘Pay the 50 € deposit (arrhes) by card – order with obligation to pay’ button. Until then, neither of us is bound.
Time limit for payment. You then undertake to pay me the deposit within the time limit that applies to the means of payment you chose (article 7). During that time, the slot is held in your name and I do not offer it to anyone else. If the deposit has not been paid in time, the order is automatically cancelled, with no fee or penalty for you: the slot is released, neither of us is bound any longer and, while your booking link is valid, you can choose another slot.
- By bank transfer: you have 48 hours, and your booking is confirmed when the deposit reaches my account. If your transfer reaches me after the order has been cancelled, I confirm the slot if it is still free; if not, I offer you another date or a full refund, as you prefer, under the conditions of article 7.
- By card: you are taken straight to SumUp’s payment page, and the slot stays held for about 30 minutes while you pay. If an attempt fails, you can try again while the slot is held. Your booking is confirmed as soon as the payment is accepted. If, exceptionally, a card payment goes through after the order has been cancelled, I confirm the slot if it is still free; if not, the amount is automatically refunded to your card.
As soon as the deposit has been received, whichever way you paid, I confirm the booking by email, on a durable medium. This email sets out the identity of the service provider, the service, the date, time and place of the appointment, the estimated price, the deposit paid and the balance, the rescheduling and cancellation rules, the right of withdrawal with the link to the withdrawal button and the model form, the mediator’s details and a link to these terms.
Article 4 – Deposit (arrhes)
To book a date, you pay a 50 € deposit as arrhes, within the meaning of article L214-1 of the French Consumer Code and article 1590 of the French Civil Code. The deposit is deducted from the final price of your tattoo.
Arrhes allow either of us to back out of the commitment:
- if you call off the appointment – other than by exercising your right of withdrawal (article 6) or in the cases of free rescheduling (article 5) – I keep the deposit;
- if I call off the appointment, I refund twice the deposit, i.e. 100 €, unless you freely choose a new date from my available slots, in which case your deposit is carried over to the new appointment.
If force majeure prevents either of us from keeping the appointment, you choose between a full refund of the deposit and carrying it over to a new date. Under article 1218 of the French Civil Code, force majeure is an event beyond the control of the party affected, which could not reasonably have been foreseen when the contract was made and whose effects cannot be avoided by appropriate measures.
Article 5 – Rescheduling and cancellation by you
Free rescheduling. You can move your appointment once, free of charge, if you ask me at least 72 hours beforehand, from your appointment page or by email. The new date is chosen from the slots I have opened, within 3 months of your request; your deposit is carried over to it.
Late or repeated rescheduling. A request received less than 72 hours before the appointment, or any further request after a first change of date, counts as a cancellation by you and I keep the deposit, unless I agree to move the appointment.
Health or skin contraindication. If your health or the condition of your skin means the tattoo cannot be done safely (sunburn, infection, pregnancy, medical treatment and so on), rescheduling is free, even less than 72 hours before the appointment. Your word is enough: no medical certificate is required. Just let me know as soon as you can.
Cancellation. If you cancel your appointment outside the withdrawal period (article 6), I keep the deposit, in accordance with article L214-1 of the French Consumer Code.
No-show or late arrival. If you do not turn up, or arrive more than 30 minutes late without letting me know, the appointment is treated as cancelled by you and I keep the deposit.
Article 6 – Right of withdrawal
As the booking is made at a distance, you have 14 days to withdraw from the contract, without giving any reason and without bearing any costs other than those set out below (article L221-18 of the French Consumer Code). The law runs this period from the day the contract is formed; to your advantage, I run it from the day your deposit reaches me (transfer credited to my account or card payment accepted), which is also the day your booking is confirmed. Its end date is shown in the confirmation email. Even before your deposit arrives, you can back out of your order simply by not making the transfer or not completing the card payment: the order is then cancelled at no cost when the time limit for payment expires (article 3).
How to withdraw. The simplest way is to click the ‘Withdraw from the contract here’ button on your appointment page, which you can reach from the confirmation email, then confirm. An acknowledgement is emailed to you straight away. You can also send me, before the period ends, the model form in the annex or any other unequivocal statement, by email to contact@sergiodurotattoo.com.
Refund. I refund the deposit in full no later than 14 days after being informed of your decision, using the same means of payment as you used (article L221-24 of the French Consumer Code): by bank transfer to the account the payment came from or, if you paid by card, to that card, through SumUp, unless you expressly agree to another means. The refund costs you nothing.
Appointment within the withdrawal period. If the slot you choose falls within the 14-day period, the service can only begin before the period ends if you expressly ask for it, by ticking the box provided on your booking page. By ticking it, you also acknowledge that you will lose your right of withdrawal once the tattoo has been fully completed.
If you withdraw after the service has begun, you owe me an amount corresponding to the work done until you told me of your decision, in proportion to the total agreed price (article L221-25 of the French Consumer Code). This amount is set against the deposit, and I refund any surplus.
End of the right of withdrawal. Under article L221-28, 1° of the French Consumer Code, the right of withdrawal can no longer be exercised once the service has been fully performed, where performance began with your prior express consent and your acknowledgement that you would lose this right.
Once the withdrawal period has ended, any cancellation is governed by article 5.
Article 7 – Payment
Prices are given in euros. VAT not applicable, article 293 B of the French General Tax Code.
Deposit. You pay the deposit in euros, either by bank transfer or by card; you choose how to pay on your booking page, before confirming your order. The amount is the same either way: I charge no payment fee, and the means of payment changes nothing in the rules of articles 4 to 6 (deposit, rescheduling, cancellation, withdrawal).
- Bank transfer, to my business account, within 48 hours of your order (article 3). My bank details, the amount and the reference to include in the transfer description are shown on your personal booking page and in the email you receive when you confirm your order. What counts is the date the transfer reaches my account, so an instant transfer is recommended: a standard transfer can take one working day, longer around a weekend or bank holiday. Any fees charged by your own bank, for instance for a transfer from Switzerland, are yours to pay.
- Card, straight after your order, on the payment page of SumUp (SumUp Limited, an electronic money institution authorised by the Central Bank of Ireland), to which you are taken. You enter your card details there; they do not pass through this site. Your bank may ask you to authenticate the payment (3-D Secure). If your card account is in a currency other than the euro, your bank converts the amount on its own terms.
Security. My bank details are only ever given to you on your personal booking page and in the emails about your booking, and I will never ask you to change them. If anyone asks you, in my name, to send a transfer to other bank details, do not make it, and let me know. Card payments are made only on SumUp’s page at checkout.sumup.com, opened from your booking page: I will never ask for your card details by email, message or phone.
Refunds. Whenever a deposit is to be returned to you (withdrawal, cancellation by me, force majeure, a payment received after the order was cancelled), I refund it using the means of payment you used, at no cost to you, no later than 14 days after your withdrawal or the event giving rise to the refund:
- deposit paid by bank transfer: by transfer to the account the payment came from. If the details of that account do not appear on my bank statement, I will ask you by email for the details of the account to credit;
- deposit paid by card: to the card used, through SumUp. How long the refund then takes to show on your statement depends on your bank.
Where I have to return twice the deposit (article 4) and you paid by card, the deposit is refunded to your card and the additional amount is paid to you by bank transfer: I will ask you by email for the details of the account to credit.
Balance. The final price, minus the deposit, is paid at the studio at the end of the session, on the same day, in cash or by bank card.
At the studio, you receive a bill detailing the service and its price.
Article 8 – Health and age
Age. Only people aged 18 or over can book online. You may be asked for photo ID at the studio.
Information on risks. In accordance with the French ministerial order of 3 December 2008 (arrêté du 3 décembre 2008), before the session I inform you of the risks of tattooing (it is irreversible and painful, with a risk of infection or allergy), the contraindications and the precautions to take while it heals. This information is also given to you in writing at the studio.
Your health. Before the session, at the studio, tell me about anything that affects your safety: an illness or current treatment, an allergy, pregnancy, or a skin condition on the area. This information has no place in the online form. If in doubt, ask your doctor first.
Safety. I may refuse to start, or postpone a session, if it cannot be done safely: for example because of a contraindication, irritated, burnt or broken skin on the area, or intoxication. Where a health or skin contraindication is the reason, rescheduling is free (article 5).
Aftercare. How well a tattoo heals also depends on following the written aftercare instructions I give you. If you have an unusual reaction, contact me and see a doctor.
Article 9 – Design and intellectual property
The design I create for your tattoo is an original work, protected by French intellectual property law: I remain its author and keep the rights to it. You are, of course, free to show and photograph your tattoo.
The design (sketches, files, stencils) may not be reproduced, tattooed by another artist or used commercially without my written consent.
For the images you send me as references (a photo of a loved one or a pet, an existing artwork), you confirm that you hold the necessary permissions, in particular, where required, from the person shown or from the author of the image.
Article 10 – Photos of your tattoo
I do not publish any photo of your tattoo – on this website, on Instagram or anywhere else – without your written consent, given separately from the booking. You are free to refuse, with no effect whatsoever on your appointment or the price. You can also set limits, for example that your face must not appear.
You can withdraw your consent at any time by email: I then remove the photos from this website and from my accounts as soon as possible. Copies already shared by others may, however, be beyond my control.
The photos of your skin sent with your request are used only to study your project. How long they are kept and your rights are set out in the privacy policy.
Article 11 – Complaints and mediation
For any complaint, please write to me first at contact@sergiodurotattoo.com, describing the problem: I reply personally and we look for a solution together.
If your written complaint does not settle the matter, you may refer it, free of charge, to the consumer mediator I am affiliated with, under articles L612-1 et seq. of the French Consumer Code:
- CM2C – Centre de la médiation de la consommation de conciliateurs de justice
- Address: 49 rue de Ponthieu, 75008 Paris, France
- Website: www.cm2c.net
- Online referral form: www.cm2c.net/declarer-un-litige.php
- Email: declarer-un-litige@cm2c.net
Under article L612-2 of the French Consumer Code, a dispute can only be referred to the mediator if you have first tried to settle it directly with me through a written complaint sent to contact@sergiodurotattoo.com, and no later than one year after that complaint.
Article 12 – Governing law and language
These terms are governed by French law. This choice does not deprive you of the protection given to you by the mandatory provisions of the law of your country of habitual residence, where they apply.
Failing an amicable solution, you may bring proceedings, as you choose, before one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or before the court for the place where you lived when the contract was made or when the harmful event occurred (article R631-3 of the French Consumer Code).
These terms are written in French; the versions in other languages, including this English version, are courtesy translations. In the event of any discrepancy, only the French version is binding.
Annex – Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract. You can also use the ‘Withdraw from the contract here’ button on your appointment page.
